Application process

  • Complete application form.
  • Provide either photo samples, or set up a meeting date and time for items to be brought in.
    • Samples can be sent in by e-mail (jpg) or dropped off at Market office.
    • Meetings can be arranged during Market office hours:
      • Tuesday to Friday: 9 a.m. - 4 p.m.
      • Saturday: 7 a.m. - 2 p.m.
  • Upon approval of items (or services), vendor start date will be determined between vendor and Market Manager.

The Kitchener Market reserves the right to limit the number of Crafters who sell similar items. Individuals interested in being placed on a waiting list will be notified when a space becomes available.

Rates for 2022

  • The Kitchener Market offers one standard rate for all tables in all Small Business Area locations.
  • Winter rates include the use of one table and one chair, which will be set-up by Market Staff the Friday afternoon prior. Summer rates include the use of a 10x10 tent, a table may be rented at an additional cost. 
  • All payments are required to be made two weeks prior to the intended Saturday, and all payments are non-refundable.
  • Payments may be made online or at the office.
  • Current rate for 2022: $53.49 HST incl.

Table Information

The Kitchener Market currently offers renting space on the upper level of the market during the winter season, and outdoors on Eby St. during the summer season.

Approved on a first come, first serve basis for vendors who have been approved by market office staff and have paid the table rate. 

Other important information

  • Vendors may sell only those products they have been approved for. If a vendor wishes to sell other products they must first apply to sell these with the market staff.
  • Vendors may not sublet or rent out their booth to another seller.
  • Vendors are expected to attend the market in person to sell their own products. Occasional use of booth sitters is permitted.
  • Booths should have an attractive and professional appearance, enhanced by good presentation and cleanliness. Any extra display material provided over and above what will fit on the tables provided must be cleared with market staff before market day.

Small business table market hours of operation

Saturday: 7 a.m. - 2 p.m.

  • Vendors must be set up by 7 am and stay until 2 pm on market day. Late comers cannot be guaranteed a booth. Late setups and early takedowns are very disruptive to the customers and other vendors. Set up can be done between 5 and 8 p.m. on Friday evening or before 7 a.m. on Saturday. If you are not able to get to the Kitchener Market until later, please discuss this with Market staff ahead of time.
  • Small Business table vendors must be fully packed and ready to leave 1 hour after the close of the market. Table vendors may not leave the Market early. Vendors will not pack up before the end of market hours. 

Security

The Kitchener Market has security that patrols the area however the venue is a downtown public space. It is the exhibitor’s responsibility to watch your items at all times. Do not leave your booth unattended. The Kitchener Market is not responsible for theft or damage of any items at any time.

Parking

Market vendors are not permitted to park in the P2 parking garage as the spots are limited.

Small business vending policies & procedures

Rules and regulations

  1. All products sold must comply with all Federal, Provincial and Municipal laws, standards and policies regarding the sale of these products.
  2. The City reserves the right to schedule the rotation of Small Business Vendors to provide a changing selection for customers.
  3. The reservation dates for tables will be allocated in a manner viewed as being in the best interests of the City.
  4. If, at the sole discretion of the City, a Small Business vendor is not making a positive contribution to the Kitchener Market, is the recipient of complaints concerning product quality, or is not in compliance with the City Behaviour Management Policy, then the Small Business vendor may lose his/her right to sell within the Kitchener Market. The City will not be obliged to refund any rental payments.
  5. Smoking is prohibited on the Kitchener Market premises.
  6. Small Business vendor’s merchandise must be displayed in a manner approved by the City, at the City’s sole discretion. Tables and chairs are the only equipment pieces provided to a Small Business vendor.
  7. The Small Business vendor must supply his/her own equipment including, but not limited to, lamps, electric outlet adapters, extension cords. The City reserves the right to limit the total electrical amperage to the assigned licensed space.
  8. Display and signage must be approved by the City and must not exceed 3 feet in height by 3 feet in width maximum height at floor level.
  9. All displays must be safe and aesthetically pleasing, at the sole discretion of the City, and in accordance with City policies.
  10. Signage shall contain no misleading information.
  11. Common aisles must be kept clear of all equipment and stock at all times. All additional equipment must be stored out of view within the assigned licensed space.
  12. Small Business vendors are solely responsible for clean up of the assigned licensed space.
  13. Loading and unloading is permitted in the designated loading zones as assigned. 

Hours of Operation

  1. Small Business vendors are to be fully operational no later than 7 a.m. and begin break down no earlier than 2 p.m. on Saturdays.
    • Market hours: Saturdays from 7:00 a.m. to 2:00 p.m.
  2. Small Business vendors are required to vacate the Kitchener Market premises within one hour after closing. Kitchener Market’s hours and space allocation are subject to change at the discretion of the City.

Rates

Small Business vendor rates for 2022 are as follows: Saturdays - $53.49 HST incl.

Payment

  1. Small Business vendor payment must be made in full no later than two weeks prior to occupancy.
  2. Rental payments must be made online, in cash or by cheque payable to The Corporation of the City of Kitchener. Receipts will be issued upon payment prior to set up.
  3. No shows will be charged 100% of the rental fees and no refunds will be permitted.
  4. Cancellations must be received by the City Kitchener Market staff within 48 hours of their Saturday booking. The City reserves the right to adjust or alter the policies and regulations as is necessary for the operation of the Kitchener Market.

Waiver of Rights

The Vendor (for itself and its insurer) hereby releases the City and its employees and agents and waives any rights, including rights of subrogation; it may have against them for compensation for any loss or damage occasioned by Vendor or loss of use of property of the Vendor.

Covenants Joint and Several

If there is more than one proprietor or partner in the Vendor’s business all covenants and agreements on the part of the Vendor are joint and several by such persons.

Severability

If any provision in this Agreement is held by any court to be invalid, void, or unenforceable, the remaining provisions will nevertheless continue in full force and effect.

Hold Harmless

The Vendor personally, and jointly and severally, agrees to indemnify and hold harmless the City from and against any and all losses, claims, actions, damages, liabilities, costs and expenses, including reasonable legal fees, in connection with loss of life, personal injury, damage to property or any other loss or injury whatsoever, arising from or out of any occurrence in, upon or at the Vendor licensed premises or at the Kitchener Market, or arising from or out of the occupancy or use by the Vendor of the licensed premises or the Market by the Vendor. If the City shall be made a party to any litigation commenced by or against the Vendor, then the Vendor shall protect, indemnify and hold the City harmless and shall pay all costs, expenses and reasonable legal fees incurred or paid by the City in connection with such litigation. The Vendor shall also pay all costs, expenses and legal fees that may be incurred or paid by the City in enforcing the terms covenants and conditions of this Agreement.

Conduct of Business

The Vendor agrees to abide by all the rules and regulations established by the City, as determined in the City’s sole discretion and as detailed in this license agreement.

Provisions

  1. Occupancy Granted: The City hereby grants to the Vendor the nonexclusive privilege to operate a day table for the sale of ____________________, at the Kitchener Market, located at 300 King Street East, Kitchener, Ontario, (hereinafter, the "Kitchener Market".)
  2. Term: The term of this Agreement (the "Term") will be commencing ______________ and ending ___________ unless terminated earlier, at the sole discretion of the City. The Term is renewable solely at the discretion of the City.
  3. Fee: The Vendor agrees to pay the fees of $45.50 HST incl. as outlined in SCHEDULE A - "Small Business Vending Policies & Procedures Rules and Regulations", attached to this Agreement.
  4. Conduct of Business: The Vendor agrees to abide by all the rules and regulations established by the City, as determined in the City’s sole discretion and as detailed in SCHEDULE A - "Small Business Vending Policies & Procedures Rules and Regulations", attached to this Agreement.
  5. Hold Harmless: The Vendor personally, and jointly and severally, agrees to indemnify and hold harmless the City from and against any and all losses, claims, actions, damages, liabilities, costs and expenses, including reasonable legal fees, in connection with loss of life, personal injury, damage to property or any other loss or injury whatsoever, arising from or out of any occurrence in, upon or at the Vendor licensed premises or at the Kitchener Market, or arising from or out of the occupancy or use by the Vendor of the licensed premises or the Market by the Vendor. If the City shall be made a party to any litigation commenced by or against the Vendor, then the Vendor shall protect, indemnify and hold the City harmless and shall pay all costs, expenses and reasonable legal fees incurred or paid by the City in connection with such litigation. All prior negotiation, representation and Agreements between the parties are merged herein. This Agreement and the attachment(s) may be amended or modified only by written instrument executed by all parties.
  9. Severability: If any provision in this Agreement is held by any court to be invalid, void, or unenforceable, the remaining provisions will nevertheless continue in full force and effect.
